If you missed filing years while abroad, the IRS offers multiple paths to catch up with different penalties depending on whether your non-compliance was willful. The Streamlined Foreign Offshore Procedures offer zero penalties for qualifying taxpayers.

The Streamlined Filing Compliance Procedures are the primary remedy for non-willful noncompliance. Under the Streamlined Foreign Offshore Procedures (for taxpayers who lived outside the US), you file 3 years of delinquent income tax returns and 6 years of delinquent FBARs. The key benefit: zero penalties for qualifying taxpayers. You must certify under penalty of perjury that your failure to file was non-willful -- due to negligence, inadvertence, or a good-faith misunderstanding of the law.

Domestic Streamlined Procedures carry a penalty. If you do not qualify as a foreign resident (for example, you recently returned to the US), the Streamlined Domestic Offshore Procedures apply instead. The filing requirements are the same -- 3 years of returns, 6 years of FBARs -- but you pay a 5% penalty on the highest aggregate balance of your foreign accounts during the 6-year FBAR period.

Voluntary Disclosure is the path for willful non-filers. If you knew about the filing obligation and deliberately chose not to file, the Streamlined program is not available. The IRS Voluntary Disclosure Program provides a structured resolution with higher penalties but protection from criminal prosecution.
